Terms and Conditions of Sale — Accommodation Services

1. Identification of the operator

2. Purpose

These General Terms and Conditions of Sale govern the sale of accommodation services provided by PHN Consulting within the framework of CNSPF 2027, on behalf of participants. They specify the respective rights and obligations of the company and the customer in accordance with Articles L211-1 et seq. of the French Tourism Code.

3. Services oFered

The company acts as a travel operator, responsible for marketing hotel accommodation negotiated with partner establishments for the duration of the conference.
The services include accommodation only (unless otherwise stated in the offer description). Any additional services (meals, tourist taxes, extras) are to be paid directly to the hotel.

4. Prices

Prices are quoted in euros, including all taxes. They include taxes applicable on the day of booking. Any changes in taxes (VAT, tourist tax, etc.) will be automatically reflected in the final price.
PHN Consulting does not apply any margin, as the rates are those negotiated with partner hotels.

5. Reservation and payment

The reservation is considered firm and final after full payment online via the website.
Payment is collected by PHN Consulting, which acts as a reseller of overnight stays and will then transfer the amounts to the hoteliers in accordance with the contractual agreements.

6. Cancellation and modification conditions

Cancellation and modification conditions depend on each hotel and are specified on the description sheet at the time of booking.
Any request for cancellation or modification must be sent in writing to contact@phnevents.com
In the event of cancellation:
• before the deadline set by the hotel: full refund, less any fees;
• after this date or in the event of a no-show: no refund will be possible.

7. Liability

PHN Consulting is responsible for the proper performance of the obligations arising from the contract concluded with the customer, in accordance with Article L211-16 of the French Tourism Code.
However, the company cannot be held liable:
• _for any event attributable to the customer (delay, absence, inappropriate behavior, etc.);
• _or any unforeseeable or insurmountable event caused by a third party unrelated to the provision of services (force majeure, strike, pandemic, etc.).

8. Complaints

Any complaint relating to a service must be sent in writing within 30 days of the date of the stay to the following address:

9. Protection of personal data

The data collected during the booking process is necessary for processing the order. It is intended for PHN Consulting and its hotel partners. In accordance with Regulation (EU) 2016/679 (GDPR), the customer has the right to access, rectify, and delete data concerning them

10. Applicable law and jurisdiction

These terms and conditions are subject to French law. In the event of a dispute, and unless otherwise required by law, the competent courts shall be those of the registered office of PHN Consulting.

11. Legal provisions – _Tourism Code

In accordance with Article R211-4 of the Tourism Code, extracts from the legal provisions applicable to contracts for the sale of travel and holidays are included in the appendix to these GTC.

LEGAL APPENDIX — EXCERPT FROM THE TOURISM CODE

Articles R211-3 to R211-11 of the Tourism Code

Article R211-3

Subject to the exclusions provided for in the third and fourth paragraphs of Article L.211-7, any offer and sale of travel or vacation services shall give rise to the provision of appropriate documents that comply with the rules defined in this chapter.

Article R211-3-1

The exchange of pre-contractual information or the provision of contractual terms and conditions shall be carried out in writing. This information may be transmitted electronically.
The name or business name and address of the organizer or retailer, as well as their registration number in the register mentioned in Article L.211-18, must be provided.

Article R211-4

Prior to the conclusion of the contract, the organizer or retailer must provide the traveler with the following information:
1. The main characteristics of the travel services offered;
2. The identity of the service provider (address, contact details);
3. The total price of the trip and the terms of payment;
4. The minimum number of people required for the trip to take place and the deadline for notification in the event of cancellation;
5. The cancellation and modification conditions;
6. Information relating to traveler protection in the event of insolvency.

Article R211-5

The information provided to the traveler in advance is binding on the organizer or retailer, except in the case of legitimate changes made before the contract is concluded.

Article R211-6

The contract must be drawn up in writing, given to the traveler, and signed by both parties. A copy must be given to the traveler.

Article R211-7

The contract must specify the following:
• the destination, dates and, where applicable, means of transport;
• the characteristics of the accommodation;
• the meals provided;
• the total price and payment terms;
• any special conditions requested by the traveler and accepted by the seller;
• complaint procedures;
• the deadlines and conditions for cancelling the contract;
• information relating to insurance and financial guarantees.

Article R211-8

The traveler may transfer their contract to a third party, after informing the organizer within a reasonable time frame.

Article R211-9

Before departure, the organizer may unilaterally modify certain terms and conditions of the contract, provided that the modification is minor and that the traveler is informed.

Article R211-10

If, before departure, the organizer cancels the trip, the traveler shall receive a full refund of the
sums paid, without additional compensation.

Article R211-11

The organizer is responsible for the proper performance of the travel services provided for in the contract and must provide appropriate assistance to travelers in difficulty
